User agreement.

This is the legal stuff. WelcomeStay will attempt to be as liberal as is feasibly possible but, as you probably understand, must cover itself for any eventualities.

By using #WelcomeStay you are agreeing to the following terms, which are designed to make sure that #WelcomeStay works for everyone.
Using WelcomeStay

As a condition of your use of WelcomeStay you agree that you will:

• Be friendly, polite, tollerant, repectful, honest and gracious to users online and when meeting other users face to face.
• Hosts must offer a warm welcome and ensure the safety of guests.
• Guests agree to be respectful of thier host’s feelings, culture, family and home.

As a condition of your use of WelcomeStay you agree that you will not:

• violate any laws;
• post any threatening, abusive, defamatory, obscene or indecent material;
• be false or misleading;
• infringe any third-party right;
• distribute or contain spam, chain letters, or pyramid schemes;
• distribute viruses or any other technologies that may harm WelcomeStay or the interests or property of WelcomeStay users;
• impose an unreasonable load on our infrastructure or interfere with the proper working of WelcomeStay;
• copy, modify, or distribute any other person’s content without their consent;
• use any robot spider, scraper or other automated means to access WelcomeStay and collect content for any purpose without our express written permission;
• harvest or otherwise collect information about others, including email addresses, without their consent;
• bypass measures used to prevent or restrict access to WelcomeStay;
• Conduct any business that may be construed as soliciting sex.
• Attempt to use high pressure sales techniques for additional services or to make hidden charges for services not agreed, assumed free or assumed to be included. All prices must be made clear and agreed before hand. Unfair behavior will result in an imediate ban from WelcomeStay and use of any of our services.

You are solely responsible for all information that you submit to WelcomeStay and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breeching the above terms. We also reserve the right at our discretion to restrict a user’s usage of the site either temporarily or permanently, or refuse a user’s registration. There are no refunds of any fees collected for any reason whatsoever.

Abusing WelcomeStay
WelcomeStay and the WelcomeStay community work together to keep the site working properly and the community safe. Please report problems, offensive content and policy breaches to us using the reporting system.
Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off WelcomeStay if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off WelcomeStay or not, we do not accept any liability for monitoring WelcomeStay or for unauthorized or unlawful content on WelcomeStay or use of WelcomeStay by users.

WelcomeStay Community
Some of WelcomeStay’s features may display your ad on other sites that are part of the WelcomeStay community. By using WelcomeStay, you agree that your adverts or profile content, including images and any associated media can be used within the WelcomeStay community for any mutually beneficial purpose.

Fees and Services
Using WelcomeStay is often free, but we may charge fees for additional services such as advert highlights and optimal placements. If the service you use incurs a fee, you’ll be able to review the total that will be clearly disclosed at the time you post your ad. Our fees are quoted in US dollars. We may change the fee structure regularly. WelcomeStay will notify you of changes to our fee policy by displaying them before you elect to choose the services and to pay. We may choose to temporarily change our fees for promotional events or new services; we reserve the right to change or discontinue promotions at any time and without warning.
Our fees are non-refundable, and you are responsible for paying them when they’re due. If you don’t, we may limit your ability to use the services. If your payment method fails or your account is past due, we may remove profiles or the additional options applied to the profile..

Content
WelcomeStay contains content from us, you, and other users. WelcomeStay is protected by copyright laws and international treaties. Content displayed on or via WelcomeStay is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions. You agree not to copy, distribute or modify content from WelcomeStay without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in WelcomeStay. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of WelcomeStay (other than your own content). When you give us content, you are granting us and representing that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. WelcomeStay administrators may remove profiles, paid or otherwise, and edit or remove content without warning or notice.

Infringement
Do not post content that infringes the rights of third parties, This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sale). A large number of varied services and products are offered on WelcomeStay by businesses and private individuals from around the world. Entitled parties, in particular the owners of copyright, trademark rights or other rights owned by third parties can report any offers which many infringe on their rights, and submit a request for this offer to be removed. If a legal representative of the entitled party reports this in the correct manner the user will be deemed responsible and contacted with instructions to correct the infringement. As a last resort WelcomeStay will act.
Reporting an infringement:
First You must contact the business or individual directly with evidence that the parties reporting these infringement are either the entitled party or their officially authorized representative. The user agrees to alter or delete the infringement appropriately.
If this action is unsuccessful you may then contact us by using the Contact Us area of the WelcomeStay Site with information about the infringement. This information must include previous correspondences, including evidence of your entitlement, and information that will enable WelcomeStay to identify the advertisement to be removed. Once we have received and reviewed your claim we will remove the infringement and ban the user for non-compliance with WelcomeStay terms and conditions.

Liability

The use of the suggested #welcomestay hashtags on Twitter is down to the sole discretion and responsibility of the user.

Nothing in these terms shall limit our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other users post or do.
We do not review users’ postings and are not involved in the actual transactions between users. As most of the content on WelcomeStay comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered.
In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.
The Site is provided to you on an “AS IS” and “WITH ALL FAULTS” basis. You assume the entire risk of loss in using the Site. Due to its large size and complexity, the Site may contain inaccuracies, omissions, errors or other defects. WelcomeStay and its suppliers do not warrant that the Site will meet your needs or expectations, that the Site will be error free or uninterrupted, that errors can or will be corrected, that the Site is reliable or timely, or that any information on the Site will provide any particular results or usefulness. WelcomeStay and its suppliers reserve the right to make changes and improvements to, or discontinue, the Site or any part thereof. Further, WelcomeStay does not represent that the Site is appropriate or authorized for use in all countries, states, counties or other jurisdictions; accordingly, you are responsible for compliance with all applicable laws in accessing the Site. WelcomeStay reserves the right to list or not to list any business or individual offering services which, in WelcomeStay’s sole judgment, meets the general requirements of the customer including some that may not.

WELCOMESTAY AND ITS SUPPLIERS MAKE AND YOU RECEIVE NO WARRANTY, WHETHER EXPRESS OR IMPLIED, AND ALL WARRANTIES, EXPRESS AND IMPLIED, ARE EXPRESSLY EXCLUDED AND DISCLAIMED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, AND FITNESS FOR ANY PARTICULAR PURPOSE.

IN NO EVENT SHALL WELCOMESTAY OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES, CLAIM OR LOSS INCURRED BY YOU (INCLUDING WITHOUT LIMITATION COMPENSATORY, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, LOST PROFITS, LOST SALES OR BUSINESS, EXPENDITURES, INVESTMENTS, OR COMMITMENTS, LOSS OF ANY GOODWILL, OR DAMAGES RESULTING FROM LOST, DAMAGED OR MISAPPROPRIATED DATA, INABILITY TO USE DATA, DELAYS, INTERRUPTIONS, OR COMPUTER VIRUSES), IRRESPECTIVE OF WHETHER WELCOMESTAY OR ITS SUPPLIERS HAVE BEEN INFORMED OF, KNEW OF, OR SHOULD HAVE KNOWN OF THE LIKELIHOOD OF SUCH DAMAGES. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE INCLUDING WITHOUT LIMITATION BREACH OF CONTRACT, BREACH OF WARRANTY, DEFAMATION, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, AND OTHER TORTS, AS WELL AS THIRD-PARTY CLAIMS. IF THE WARRANTY EXCLUSION OR LIMITATION OF LIABILITY SET FORTH IN THIS AGREEMENT SHALL FOR ANY REASON WHATSOEVER BE HELD UNENFORCEABLE OR INAPPLICABLE, USER AGREES THAT WELCOMESTAY AND ITS SUPPLIERS’ LIABILITY SHALL NOT EXCEED $00.01 U.S. Some sovereignties and states do not allow the exclusion or limitation of incidental or consequential damages or the limitation of duration of an implied warranty, so the limitation or exclusion herein may not apply to you. If this is the case you may not use services offered by WelcomeStay or any of its associated business unless you, or any third party acting on your behalf, agree to not to pursue any legal action against WelcomeStay. The responsibility to abide with the laws of their own countries and of the laws of other sovereignties lies solely with the user.

Personal Information
By using WelcomeStay, you agree to the collection, transfer, storage and use of your personal information by WelcomeStay on servers located around the world as described in our Privacy Policy. You also agree to receive marketing communications from us unless you tell us that you prefer not receive such communications.

Resolution of disputes
If a dispute arises between you and WelcomeStay, we strongly encourage you to first contact us directly to seek a resolution by going to the WelcomeStay FAQ page and following the links to the relevant area of the site. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

General
These terms and the other policies posted on WelcomeStay constitute the entire agreement between WelcomeStay and you, superseding any prior agreements.
This Agreement shall be governed and construed in all respects by the laws of England and Wales and where necessary in the country pertinent to the case on an individual basis. You agree that any claim or dispute you may have against WelcomeStay must be resolved by the courts of England and Wales. You and WelcomeStay both agree to submit to the exclusive jurisdiction of the English Courts.
If we don’t enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.
Except for notices relating to illegal or infringing content, your notices to us must be sent via our Contact Us pages. We will send notices to you via the email address you provide, or by registered mail.
We may update this agreement at any time, with updates taking effect when you next post immediately after we post the updated policy on the site, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.
